Өнөөдөр олон улсын шинжээчдийн шалгуураар авч үзвэл манай   оронд үйл ажиллагаа явуулж буй нийт ХМХ-ийн 90 орчим хувь нь төр, засгаас хараат бус, төр засгийн ямар ч өндөр албан тушаалтнуудыг чөлөөтэй шүүмжилдэг, төр засгаас сэтгүүл зүйд шууд байдлаар үзүүлэх дарамт шахалт харьцангуй бага байгаа юм. Гэхдээ энэ бол бүх юм сайн сайхан байна гэсэн үг хараахан биш юм. Миний бие тус эрдэм шинжилгээний илтгэлээрээ манай орны хэвлэлийн эрх чөлөө хэр бат бөх оршин тогтнож байгааг 2008 оны долдугаар сарын 1-ээс долдугаар сарын 6-ны онц байдал зарласан өдрүүдээр жишээлэн батлахыг хүссэн юм.

Хоёр. Нийтлэг үндэслэл
Тун удахгүй хэвлэлийн эрх чөлөөний өдөр болно. Хэвлэлийн эрх чөлөө гэдэг нь “Хөндлөнгийн нөлөөлөл, оролцооноос ангид чөлөөтэй байх явдал” хэмээн Олон Улсын Сэтгүүлчдийн Холбоо (ОУСХ) тодорхойлсныг НҮБ, олон улсын хүний эрхийн байгууллага, улс орнуудын засгийн газар хүлээн зөвшөөрсөн байдаг. ОУСХ-ны 21-р их хурлаас батлагдсан “Ардчилсан хэвлэл мэдээллийн хэрэгслийн соёлын тунхаг”-т “Ардчилсан нийгэмд мэдээллийн хэрэгслийн гүйцэтгэх үүрэг онцгой өвөрмөц агаад тухайлсан үүргийг ухаарч сэхээрсэн тэр цагт ардчилал бүрнээ үнэ хүндтэй болох учиртай” (орч. Ц.Дашдондов) гэсэн байдаг.3 Тэгвэл ардчилал үүсч, хөгжөөд 18 жилийг ардаа орхисон манай оронд хэвлэлийн эрх чөлөө жинхэнэ утгаараа байгаа эсэх нь эргэлзээтэй. Ардчилал сонины 2008 оны долдугаар сарын 6-ны №133 дугаарт “Долдугаар сарын 6-ыг Монголын хэвлэлийн эрх чөлөөний өдөр болгоё” гэсэн гарчигтай нийтлэл хэвлэгджээ. “Онц байдал дуусч, сэтгүүлчид эрх чөлөөгөө эргүүлэн авч, хаагдсан телевизүүд нэвтрүүлгээ цацаж эхэлсэн энэ өдрийг Монголын хэвлэлийн эрх чөлөөний өдөр болгоё. Дэлхийн хэвлэлийн эрх чөлөөний өдөр жил бүрийн тавдугаар сарын 3-нд тохиодог”4 хэмээн тус нийтлэлд дурьдсан байна. Тиймээс онц байдал зарласан өдрүүдэд манай хэвлэл мэдээллийн хэрэгсэлүүд олон нийтийн эрх ашигт захирагдан хараат бус, олон ургальч байх зарчимд үндэслэн хэрхэн ажиллаж байсан хийгээд хэвлэлийн эрх чөлөө хэр бат бөх байсан зэрэг нь сонирхол татаж байгаа юм. Зарим иргэд, иргэний нийгмийн байгууллагууд, мэргэжилтэнүүдийн зүгээс ХМХ-тэй холбоотой дараах шүүмжлэл гарч байв.
1. Төр, засгаас хэвлэл мэдээллийн хэрэгслийн үйл ажиллагааг хязгаарлах эрх зүйн үндэс байхгүй байсан.5
2. Долдугаар сарын 1-ний хэвлэл мэдээлийн хэрэгслүүд, ялангуяа онц байдал зарласан хугацаанд МҮОНТ нь Монгол Улсын Үндсэн хууль, Хэвлэлийн эрх чөлөөний тухай хууль, Олон нийтийн радио телевизийн тухай хуулийг баримталж ажиллаж чадаагүй.6
3. Хэвлэл мэдээллийн хэрэгсэлүүд ялангуяа онц байдлын үеэр ажилласан МҮОНТ, зарим өдөр тутмын сонин төр засгийн хяналтан дор үйл ажиллагаагаа явуулж байсан.
