ENSAYO SOBRE LA PAZ PERPETUA

En el momento que Kant escribe su obra Sobre la paz perpetua, en Europa se desarrollaba la guerra de los 30 años, en donde se enfrentaban los católicos y los protestantes. Había enfrentamientos ideológicos que abarcaban todo campo social, provocando marcadas diferencias en la sociedad. Además los países estaban manejados por reinados, el feudalismo que tanto criticó Kant. En esa época, en Europa, los reinados eran la forma de gobierno que dominaba. Ya se habían presentado diferencias entre los reyes y el pueblo que luchaba por libertad y contra sistemas opresores.

La versión definitiva del tratado se firmó en el 22 de julio. Constaba de un preámbulo y 17 artículos. En el tratado se establecía que Francia devolvía los territorios ocupados en España. A cambio, España cedía a Francia la parte española de la isla de Santo Domingo (los franceses ya controlaban la parte occidental de la isla, Haití, desde la firma del Tratado de Ryswick en 1697) y se normalizaban las relaciones comerciales entre ambos países.
Las cláusulas secretas del tratado disponían que España no persiguiera a los afrancesados y la liberación de la hija del rey Luis XVI. Se postergó para más tarde un nuevo tratado, el que sería llamado Tratado de San Ildefonso, en el que se formalizaría una alianza contra Inglaterra.
þPara Kant la paz de acuerdo con su interpretación, una sola condición es necesaria para lograrla: una gran federación de estados comprometidos con el mantenimiento de la paz universal. A pesar de lo simple y atractivo de la propuesta, el proyecto de una federación de estados pacíficos fue considerado un ideal utópico hasta la primera década de este siglo. 
Fue recién con la irrupción de la primera Guerra Mundial, al quedar desacreditada la idea de que la paz puede ser preservada bajo un mero sistema de equilibrio de poder, que la idea de una federación internacional para la paz fue contemplada como un proyecto realizable.
þLas condiciones para que tenga lugar una paz perpetua entre los estados según Kant deben ser las siguientes:
1. “No debe considerarse como válido un tratado de paz que se haya ajustado con la reserva mental de ciertos motivos capaces de provocar en el porvenir otra guerra”. Pues sería una simple una interrupción de las hostilidades, nunca una verdadera "paz", la cual significa el término de toda hostilidad. El tratado de paz aniquila y borra por completo las causas existentes de futura guerra posible, aun cuando los que negocian la paz no las vislumbren ni sospechen en el momento de las negociaciones; aniquila incluso aquellas que puedan luego descubrirse por medio de hábiles y penetrantes inquisiciones en los documentos archivados. La reserva mental, que consiste en no hablar por el momento de ciertas pretensiones que ambos países se abstienen de mencionar porque están demasiado cansados para proseguir la guerra, pero con el perverso designio de aprovechar más tarde la primera coyuntura favorable para reproducirlas.
2. “Ningún Estado independiente -pequeño o grande, lo mismo da- podrá ser adquirido por otro Estado mediante herencia, cambio, compra o donación”. Un estado no es un patrimonio, es una sociedad de hombres sobre la que nadie ni siquiera ella misma puede disponer. Pero tampoco puede intentarlo con otro estado, del que bien dadas unas raíces, si se hiciera se eliminaría su existencia como persona moral convirtiéndola en otra cosa.
