Role and Functions of Law
The history of law goes back thousands of years. It seems that law has popped up in many civilizations at different times over the course of their evolution. The system of law practiced in the United States today is derived from the English common law that was in place during the revolutionary war. The role and function of law can be a very complicated topic for discussion. From the different licenses required simply to open the doors to laws that establish a mandatory break period for hourly staff members, running a restaurant can be a challenging task. Rest and meal breaks always have been required by law but where never enforced or came with serious penalties. In 2000 the state of California added a penalty for those businesses that were not giving their employees the appropriate rest and meal breaks. Every time that the employer failed to give an employee the correct meal break they were forced by law to pay that employee a full extra hour of pay. This may not seem like much, but it added up to thousands of dollars per pay period for larger restaurants. The new penalties were so costly that it became a major focus for every restaurant manager in every restaurant. In some restaurants this new penalty caused the creation of a new position in the industry. Restaurants started scheduling a person who would come to work just to give people breaks. This position was called the “breaker”. The breaker would watch a server’s station for the 30 minutes that they were on break, and they would then continue on to the next station.
In 1998 restaurants in Los Angeles county restaurants started receiving letter grades for their health department safety and sanitation inspections. These letter grades, a-f, were required to be posted in the window of the restaurant. This was in...
